By accepting delivery of any product purchased from Valley Electronics LLC, the purchaser, as well as any of his or her appointed agents, including but not limited to, the user of the product as well as any additional person(s) appearing by name on the order under the "ship to" and "bill to" address, together acknowledge full and complete acceptance of these terms and conditions and confirm that they will be bound by them collectively regardless of who accepts delivery, so long as such delivery is made to the correct address as stated on the order or is made to any alternate delivery address that was submitted in writing from the same e-mail address as provided on the original order.

Warranty

The manufacturer's warranty covers the original purchaser for two (2) years for Lady-Comp and three (3) years for Lady-Comp Planning Software against any defects in workmanship. The manufacturer does not provide warranty on the following parts: the sensor, power supply plug or internal battery for all devices. All maintenance services and repairs after the warranty years must be paid by the purchaser.

All items supplied by Valley Electronics LLC must be returned to Valley Electronics LLC to receive warranty repair. Please keep your invoice as your proof of purchase. BEFORE RETURNING any item please CALL US. Any additional fees paid by or billed to Valley Electronics LLC related to the return shipping of any warranty item, are the responsibility of the product owner unless terms otherwise stipulate that shipping is included. Any such extra fees will be billed to the original purchaser.

Return and Refund Policy

Before returning an item, please call Valley Electronics LLC for a Returned Merchandise Authorization (“RMA”) number. Returns will not be accepted without a pre-authorized RMA number. All returns and exchanges must be completed within thirty (30) days of delivery. Items must be returned at the purchaser’s expense whether the item is a return for refund or an exchange. A copy of the original invoice or a copy of the RMA or the customer ID number must be included as proof of purchase. Any unopened fertility monitor may be returned for a full refund (shipping costs will be deducted) within fourteen (14) days after purchaser’s receipt. To the extent a fertility monitor has been financed, any non-refundable fees related to financing will not be refunded. The monitor must be returned in its original condition, packed in the original unmarked packaging, including any accessories and manuals shipped with the product. Failure to return all items in their original condition will result in additional fees. The amount of the fee will be based on the retail cost associated with replacing any damaged or missing item(s). A 10% restocking fee applies to units returned fifteen to thirty (15-30) days after delivery. Incorrect shipping documentation may incur customs charges and taxes for which the purchaser will be responsible.

Valley Electronics LLC is the manufacturer’s U.S.-based distributor. Valley Electronics LLC does not honor returns or warranty claims from purchases made from other international resellers.
*Extra costs incurred in accepting your return such as customs duties, taxes, handling fees and brokerage fees are non-refundable and are the responsibility of the purchaser. The purchaser also agrees as acknowledged by making payments toward their purchase that any additional fees as described above may be billed to the purchaser’s credit card immediately or at a later date if additional invoices are received from customs, brokers or other agents related to the return of the item or order.

Shipping, Duties & Taxes

Our preferred carrier in North America is USPS. For all orders shipped via USPS, tracking numbers will be sent via e-mail to the e-mail address the customer provides, which will be sent from info@lady-comp.com. Any customs, duties, taxes, and brokerage fees for shipments charged during the delivery and after the original sale are the responsibility of the purchaser. Valley Electronics LLC always prepares shipments in the best interest of the customer. Valley Electronics LLC lawfully works to help its customers avoid or minimize duties and taxes where lawfully possible. In most cases, there are no duties or additional taxes charged on our shipments in the United States.

Valley Electronics LLC does not ship outside the United States and its territories. Delivery Guarantee

We include free priority shipping with each purchase. For the delivery of your order, you may choose to upgrade your shipping to 2nd Day or Next Day options. When you select the 2ndDay or Next Day delivery options (shipped via FedEx) additional charges will apply. We guarantee delivery in three (3) business days. However, we are not responsible for internal delays in the USPS or FedEx. The three (3) business-day guarantee starts twelve (12) hours after payment is received by Valley Electronics LLC. The following limitations apply to this guarantee: Valley Electronics LLC is not responsible for delays due to influences outside of its own control such as regulatory delays by customs or delays caused by improper routing or scheduling by the shipping company or any other such problem outside Valley Electronics LLC’s direct control. Valley Electronics LLC isnot responsible for delays caused by the purchaser’s inability to accept a package due to incorrect address, rerouting to a new address or due to an incorrect address including incorrect zip or postal code, or due to no one being available to accept the package. Proof of performance for this guarantee will be referenced to the date the package is picked up by the courier.

In-Stock Guarantee

Valley Electronics LLC guarantees that all fertility computers will be in stock and ready to ship from the time of order on single payment purchases within twenty-four (24) hours on regular business days and within seventy-two (72) hours on weekends and holidays.

Limitation of Liability

In no event shall Valley Electronics LLC or any of its affiliates, or the officers, directors, employees, members, or agents of each of them, be liable for any damages of any kind, including, without limitation, any special, incidental, indirect, or consequential damages, whether or not advised of the possibility of such damages, and on any theory of liability whatsoever, arising out of, or in connection with, the use of this website or the products offered on this website.

Jurisdiction

You expressly agree that exclusive jurisdiction for any dispute with Valley Electronics LLC, or in any way relating to your use of the Lady-Comp Site, resides in the courts of the State of Delaware and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Delaware in connection with any such dispute including any claim involving Valley Electronics LLC or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.
These Terms and Conditions are governed by the internal substantive laws of the State of Delaware, without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or of any other term or condition.

Indemnity
You agree to defend, indemnify, and hold Valley Electronics LLC, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.
